現將(jiang)財政部、工業和信息化部印發(fa)(fa)的(de)《政府采購促進中(zhong)小企業發(fa)(fa)展暫行辦法》(財庫〔2011〕181號,以(yi)下(xia)簡稱“《暫行辦法》”)轉發(fa)(fa)你們,并提出以(yi)下(xia)貫徹意見(jian):
一(yi)、進(jin)(jin)(jin)(jin)(jin)(jin)一(yi)步(bu)提(ti)高對政府采(cai)購促進(jin)(jin)(jin)(jin)(jin)(jin)中(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)發(fa)展重要意義的認(ren)識,加(jia)強對《暫(zan)行辦(ban)法(fa)》有關精神(shen)的學習領(ling)會。中(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)是促進(jin)(jin)(jin)(jin)(jin)(jin)國民經(jing)濟(ji)和社會發(fa)展的重要力量,對于(yu)促進(jin)(jin)(jin)(jin)(jin)(jin)科技創新、提(ti)供就業(ye)(ye)(ye)崗位、滿足社會需要具(ju)有重要作(zuo)用(yong)。但從實踐看(kan),中(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)在政府采(cai)購競爭中(zhong)仍然存在不(bu)少(shao)困難(nan)。《暫(zan)行辦(ban)法(fa)》通(tong)過預(yu)留采(cai)購份額、評審(shen)優惠、鼓勵聯合體投標和分包(bao)等措施,提(ti)高采(cai)購中(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)貨(huo)物、工(gong)程(cheng)和服務的比例,促進(jin)(jin)(jin)(jin)(jin)(jin)中(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)發(fa)展。各地(di)各部門(men)要進(jin)(jin)(jin)(jin)(jin)(jin)一(yi)步(bu)統一(yi)思(si)想、提(ti)高認(ren)識,高度重視政府采(cai)購促進(jin)(jin)(jin)(jin)(jin)(jin)中(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)發(fa)展對于(yu)保持經(jing)濟(ji)平穩較快增長(chang)的重要作(zuo)用(yong),認(ren)真抓好(hao)《暫(zan)行辦(ban)法(fa)》各項政策措施的落實,進(jin)(jin)(jin)(jin)(jin)(jin)一(yi)步(bu)營造扶持中(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)發(fa)展的良好(hao)氛(fen)圍,幫助中(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)轉(zhuan)變發(fa)展方式,實現(xian)又好(hao)又快發(fa)展。
二(er)、有(you)效清理對中(zhong)(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)參(can)與政(zheng)府采(cai)購的(de)(de)不合理限制。采(cai)購人及政(zheng)府采(cai)購代理機構應(ying)依法(fa)(fa)編(bian)制政(zheng)府采(cai)購招標文件(含談(tan)判文件、詢價文件)。制定的(de)(de)評標辦法(fa)(fa)和(he)標準(zhun)(zhun),要體現扶持中(zhong)(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)的(de)(de)政(zheng)策,將中(zhong)(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)誠信經(jing)營、依法(fa)(fa)納稅和(he)職工社會(hui)保險繳納等(deng)情況作為評分(fen)內容。不得(de)以不合理的(de)(de)條件對中(zhong)(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)實行(xing)歧(qi)視性(xing)待(dai)遇或差別(bie)待(dai)遇,不得(de)在注冊(ce)資(zi)(zi)本(ben)(ben)、業(ye)(ye)(ye)績水(shui)平、資(zi)(zi)格(ge)條件等(deng)方面限制中(zhong)(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye),不得(de)使(shi)用(yong)特(te)定供應(ying)商(shang)的(de)(de)技(ji)術標準(zhun)(zhun)排斥(chi)中(zhong)(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)。任何單位和(he)個人不得(de)阻撓和(he)限制中(zhong)(zhong)小(xiao)企(qi)(qi)(qi)業(ye)(ye)(ye)自由進入本(ben)(ben)地區和(he)本(ben)(ben)行(xing)業(ye)(ye)(ye)的(de)(de)政(zheng)府采(cai)購市場(chang)。
三、努力保證中(zhong)小(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)優(you)先獲得政府(fu)(fu)(fu)采(cai)(cai)(cai)(cai)(cai)購(gou)(gou)(gou)合同。明(ming)確中(zhong)小(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)政府(fu)(fu)(fu)采(cai)(cai)(cai)(cai)(cai)購(gou)(gou)(gou)中(zhong)標(biao)份額(e)比例標(biao)準,嚴格按(an)照比例預留專門面(mian)(mian)向(xiang)中(zhong)小(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)采(cai)(cai)(cai)(cai)(cai)購(gou)(gou)(gou)的(de)(de)(de)份額(e),對于中(zhong)小(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)有能力提供(gong)的(de)(de)(de)通用性強、標(biao)準或規格較(jiao)為統(tong)一或者預算金額(e)不超過200萬元的(de)(de)(de)小(xiao)額(e)、零(ling)星政府(fu)(fu)(fu)采(cai)(cai)(cai)(cai)(cai)購(gou)(gou)(gou)項(xiang)目(mu),在滿足采(cai)(cai)(cai)(cai)(cai)購(gou)(gou)(gou)需求的(de)(de)(de)前提下,應當(dang)面(mian)(mian)向(xiang)中(zhong)小(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)采(cai)(cai)(cai)(cai)(cai)購(gou)(gou)(gou)。對于非專門面(mian)(mian)向(xiang)中(zhong)小(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)采(cai)(cai)(cai)(cai)(cai)購(gou)(gou)(gou)的(de)(de)(de)項(xiang)目(mu),應當(dang)在評審標(biao)準等(deng)方(fang)面(mian)(mian)作出有利(li)于中(zhong)小(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)的(de)(de)(de)具體規定(ding),根據不同的(de)(de)(de)評審方(fang)式和項(xiang)目(mu)情況給予6%—10%的(de)(de)(de)價格扣除。鼓勵中(zhong)小(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)、中(zhong)小(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)與(yu)大型企(qi)(qi)(qi)(qi)業(ye)(ye)依法(fa)組成聯(lian)合體參與(yu)政府(fu)(fu)(fu)采(cai)(cai)(cai)(cai)(cai)購(gou)(gou)(gou),并分別適用相應的(de)(de)(de)價格優(you)惠幅度規定(ding),鼓勵采(cai)(cai)(cai)(cai)(cai)購(gou)(gou)(gou)人允許獲得政府(fu)(fu)(fu)采(cai)(cai)(cai)(cai)(cai)購(gou)(gou)(gou)合同的(de)(de)(de)大型企(qi)(qi)(qi)(qi)業(ye)(ye)依法(fa)向(xiang)中(zhong)小(xiao)企(qi)(qi)(qi)(qi)業(ye)(ye)分包。
四、切實(shi)減輕(qing)中(zhong)(zhong)小(xiao)(xiao)企(qi)業參(can)與(yu)政(zheng)府(fu)采(cai)(cai)購(gou)(gou)的(de)(de)負(fu)擔。政(zheng)府(fu)采(cai)(cai)購(gou)(gou)活動中(zhong)(zhong),要盡可能減免(mian)和緩收(shou)中(zhong)(zhong)小(xiao)(xiao)企(qi)業參(can)與(yu)政(zheng)府(fu)采(cai)(cai)購(gou)(gou)的(de)(de)有關(guan)費(fei)(fei)(fei)用。要開辟(pi)政(zheng)府(fu)采(cai)(cai)購(gou)(gou)項目中(zhong)(zhong)標中(zhong)(zhong)小(xiao)(xiao)企(qi)業資金支付綠色通道,在(zai)控制(zhi)履約風險的(de)(de)前提(ti)下(xia)首付款比例一(yi)般(ban)不(bu)低于50%,累計付款不(bu)超過(guo)3次。集中(zhong)(zhong)采(cai)(cai)購(gou)(gou)機構(gou)、采(cai)(cai)購(gou)(gou)人組織(zhi)政(zheng)府(fu)采(cai)(cai)購(gou)(gou),一(yi)律(lv)免(mian)收(shou)中(zhong)(zhong)小(xiao)(xiao)企(qi)業招(zhao)標文件工本費(fei)(fei)(fei),中(zhong)(zhong)小(xiao)(xiao)企(qi)業投標保證(zheng)金、履約保證(zheng)金數額應合理確定并可以免(mian)除或(huo)者減少。政(zheng)府(fu)采(cai)(cai)購(gou)(gou)代理機構(gou)也要盡可能減免(mian)中(zhong)(zhong)小(xiao)(xiao)企(qi)業參(can)與(yu)政(zheng)府(fu)采(cai)(cai)購(gou)(gou)活動的(de)(de)相(xiang)關(guan)費(fei)(fei)(fei)用。禁(jin)止任何(he)單位在(zai)法(fa)定的(de)(de)收(shou)費(fei)(fei)(fei)項目和收(shou)費(fei)(fei)(fei)標準外向(xiang)中(zhong)(zhong)小(xiao)(xiao)企(qi)業收(shou)取費(fei)(fei)(fei)用,禁(jin)止強制(zhi)或(huo)變相(xiang)強制(zhi)中(zhong)(zhong)小(xiao)(xiao)企(qi)業提(ti)供(gong)贊助或(huo)者接受有償服務(wu),禁(jin)止違法(fa)指定中(zhong)(zhong)介(jie)機構(gou)提(ti)供(gong)各種(zhong)有償服務(wu)等。
五、繼續做(zuo)好中(zhong)(zhong)小企(qi)(qi)業(ye)政(zheng)(zheng)府(fu)采(cai)(cai)(cai)購(gou)(gou)(gou)信(xin)用(yong)(yong)(yong)擔(dan)(dan)(dan)保(bao)融資平(ping)臺建設(she)。進一(yi)步貫徹落(luo)實《江(jiang)(jiang)蘇(su)(su)省(sheng)(sheng)財(cai)政(zheng)(zheng)廳?江(jiang)(jiang)蘇(su)(su)省(sheng)(sheng)人民政(zheng)(zheng)府(fu)金(jin)融工作(zuo)(zuo)辦公(gong)室<關(guan)于(yu)(yu)做(zuo)好中(zhong)(zhong)小企(qi)(qi)業(ye)政(zheng)(zheng)府(fu)采(cai)(cai)(cai)購(gou)(gou)(gou)信(xin)用(yong)(yong)(yong)擔(dan)(dan)(dan)保(bao)融資工作(zuo)(zuo)的(de)通知(zhi)>》(蘇(su)(su)財(cai)購(gou)(gou)(gou)[2010]15號)和(he)《江(jiang)(jiang)蘇(su)(su)省(sheng)(sheng)財(cai)政(zheng)(zheng)廳關(guan)于(yu)(yu)印發<江(jiang)(jiang)蘇(su)(su)省(sheng)(sheng)政(zheng)(zheng)府(fu)采(cai)(cai)(cai)購(gou)(gou)(gou)信(xin)用(yong)(yong)(yong)擔(dan)(dan)(dan)保(bao)試(shi)點工作(zuo)(zuo)實施方案(試(shi)行)>的(de)通知(zhi)》(蘇(su)(su)財(cai)購(gou)(gou)(gou)[2011]22號),推進政(zheng)(zheng)府(fu)采(cai)(cai)(cai)購(gou)(gou)(gou)信(xin)用(yong)(yong)(yong)擔(dan)(dan)(dan)保(bao)試(shi)點工作(zuo)(zuo),加強政(zheng)(zheng)府(fu)采(cai)(cai)(cai)購(gou)(gou)(gou)信(xin)用(yong)(yong)(yong)融資政(zheng)(zheng)策宣傳,協調和(he)引(yin)導金(jin)融機構和(he)專業(ye)擔(dan)(dan)(dan)保(bao)機構,建立(li)中(zhong)(zhong)小企(qi)(qi)業(ye)參(can)與政(zheng)(zheng)府(fu)采(cai)(cai)(cai)購(gou)(gou)(gou)信(xin)用(yong)(yong)(yong)擔(dan)(dan)(dan)保(bao)體(ti)系,加大對(dui)中(zhong)(zhong)小企(qi)(qi)業(ye)的(de)信(xin)貸投放,開發和(he)推廣中(zhong)(zhong)小企(qi)(qi)業(ye)政(zheng)(zheng)府(fu)采(cai)(cai)(cai)購(gou)(gou)(gou)項目專項貸款(kuan)業(ye)務,實現中(zhong)(zhong)小企(qi)(qi)業(ye)以中(zhong)(zhong)標(biao)通知(zhi)書或政(zheng)(zheng)府(fu)采(cai)(cai)(cai)購(gou)(gou)(gou)合(he)同為抵(di)押,直接向金(jin)融機構貸款(kuan),幫助中(zhong)(zhong)小企(qi)(qi)業(ye)緩解資金(jin)壓力(li)、順利組織生產、提(ti)高(gao)履約能力(li)。
六、深入(ru)開展對中(zhong)小(xiao)(xiao)企(qi)業(ye)(ye)(ye)參(can)(can)與(yu)政(zheng)(zheng)府采購(gou)(gou)的(de)(de)培(pei)訓(xun)引導(dao)。對中(zhong)小(xiao)(xiao)企(qi)業(ye)(ye)(ye)組織開展政(zheng)(zheng)府采購(gou)(gou)政(zheng)(zheng)策法規、操作流程、投標實(shi)務(wu)等業(ye)(ye)(ye)務(wu)培(pei)訓(xun),定期分析(xi)中(zhong)小(xiao)(xiao)企(qi)業(ye)(ye)(ye)參(can)(can)與(yu)政(zheng)(zheng)府采購(gou)(gou)數(shu)據信息(xi),幫助中(zhong)小(xiao)(xiao)企(qi)業(ye)(ye)(ye)了解(jie)政(zheng)(zheng)府采購(gou)(gou)扶(fu)(fu)持(chi)政(zheng)(zheng)策,熟悉參(can)(can)與(yu)政(zheng)(zheng)府采購(gou)(gou)流程,在完善企(qi)業(ye)(ye)(ye)內部管(guan)理機制的(de)(de)基礎(chu)上積(ji)極參(can)(can)與(yu)競爭。要對產品(pin)和服務(wu)質量過硬、履約誠信好、有(you)發(fa)展潛力的(de)(de)中(zhong)小(xiao)(xiao)企(qi)業(ye)(ye)(ye)給予重點扶(fu)(fu)持(chi),引導(dao)中(zhong)小(xiao)(xiao)企(qi)業(ye)(ye)(ye)更新發(fa)展觀念,調整經(jing)營結構,堅持(chi)走專業(ye)(ye)(ye)化、精品(pin)化、特色(se)化道路,開展技術創(chuang)新和品(pin)牌(pai)創(chuang)優,提(ti)高參(can)(can)與(yu)政(zheng)(zheng)府采購(gou)(gou)的(de)(de)核心競爭力,積(ji)極培(pei)育(yu)政(zheng)(zheng)府采購(gou)(gou)優秀中(zhong)小(xiao)(xiao)企(qi)業(ye)(ye)(ye)供(gong)應商隊伍。
七(qi)、科(ke)學建(jian)(jian)立中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)(qi)業(ye)參與政(zheng)府采(cai)購(gou)誠(cheng)信體系。逐步推進(jin)政(zheng)府采(cai)購(gou)供應(ying)商庫建(jian)(jian)設,完善中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)(qi)業(ye)參與政(zheng)府采(cai)購(gou)信用(yong)檔(dang)案,聯合(he)有關(guan)金融(rong)機(ji)構對(dui)企(qi)(qi)(qi)業(ye)的(de)(de)經(jing)營狀況、社會信用(yong)狀況和資(zi)信能力等(deng)進(jin)行綜合(he)評估,對(dui)信用(yong)等(deng)級較(jiao)高的(de)(de)中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)(qi)業(ye)在(zai)融(rong)資(zi)擔保等(deng)方面優(you)先給予(yu)(yu)支(zhi)持。加強(qiang)中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)(qi)業(ye)采(cai)購(gou)活動的(de)(de)誠(cheng)信監督(du),對(dui)違反誠(cheng)信原(yuan)則非法謀取中(zhong)(zhong)(zhong)標(biao)或者中(zhong)(zhong)(zhong)標(biao)后不按照(zhao)合(he)同提(ti)供產品和服務、損害采(cai)購(gou)人利益的(de)(de)中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)(qi)業(ye),視情況采(cai)取不予(yu)(yu)支(zhi)付合(he)同價款或列入不良行為(wei)記(ji)錄名單等(deng)措(cuo)施,督(du)促(cu)中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)(qi)業(ye)恪守誠(cheng)信、依(yi)法經(jing)營,為(wei)誠(cheng)信守法的(de)(de)中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)(qi)(qi)業(ye)提(ti)供更多競爭機(ji)會。
八、不斷加(jia)(jia)強政(zheng)府采購(gou)(gou)活(huo)動的(de)監督管(guan)理(li)(li)。各級財政(zheng)部門要(yao)把扶持中(zhong)小(xiao)企(qi)(qi)業(ye)(ye)(ye)發(fa)展(zhan)政(zheng)策的(de)落實情況(kuang),作(zuo)為日(ri)常監管(guan)考核的(de)重(zhong)要(yao)內容。要(yao)加(jia)(jia)強采購(gou)(gou)活(huo)動監管(guan),依法(fa)嚴格(ge)(ge)控制政(zheng)府采購(gou)(gou)進口(kou)產品(pin),為中(zhong)小(xiao)企(qi)(qi)業(ye)(ye)(ye)提(ti)供(gong)更大(da)的(de)市場(chang)空間(jian)。對采購(gou)(gou)人(ren)有意規避采購(gou)(gou)中(zhong)小(xiao)企(qi)(qi)業(ye)(ye)(ye)產品(pin)和(he)服(fu)務,或者無正(zheng)當理(li)(li)由拒絕接受(shou)合(he)同約定(ding)(ding)的(de)中(zhong)小(xiao)企(qi)(qi)業(ye)(ye)(ye)產品(pin)和(he)服(fu)務的(de),要(yao)責令改正(zheng),否則(ze)不予支付(fu)采購(gou)(gou)資金。加(jia)(jia)強供(gong)應商(shang)質疑和(he)投訴(su)處(chu)理(li)(li)工作(zuo),采購(gou)(gou)人(ren)和(he)采購(gou)(gou)代理(li)(li)機構應嚴格(ge)(ge)按照法(fa)定(ding)(ding)期限答復中(zhong)小(xiao)企(qi)(qi)業(ye)(ye)(ye)供(gong)應商(shang)的(de)質疑,不得敷衍塞責;財政(zheng)部門要(yao)及時(shi)(shi)受(shou)理(li)(li)和(he)調(diao)查中(zhong)小(xiao)企(qi)(qi)業(ye)(ye)(ye)供(gong)應商(shang)提(ti)起的(de)投訴(su),發(fa)現問題依法(fa)處(chu)理(li)(li),切實維(wei)護中(zhong)小(xiao)企(qi)(qi)業(ye)(ye)(ye)供(gong)應商(shang)的(de)合(he)法(fa)權(quan)益(yi)。積(ji)極推進政(zheng)府采購(gou)(gou)信(xin)息化建(jian)設,增加(jia)(jia)政(zheng)府采購(gou)(gou)的(de)公開(kai)性(xing)和(he)透明度,及時(shi)(shi)、完(wan)整地(di)在省級以上政(zheng)府采購(gou)(gou)監管(guan)部門指定(ding)(ding)的(de)媒(mei)體(ti)公開(kai)發(fa)布采購(gou)(gou)信(xin)息,提(ti)供(gong)便于中(zhong)小(xiao)企(qi)(qi)業(ye)(ye)(ye)獲取政(zheng)府采購(gou)(gou)信(xin)息的(de)穩定(ding)(ding)渠道(dao)。
九、《江蘇財政廳印發〈關(guan)于政府采(cai)購促進中(zhong)小企業發展(zhan)的意見〉的通知(zhi)》(蘇財購〔2009〕34號)即日起停止執行。
